The parent or legal guardian shall be jointly and severally responsible and liable for all activities conducted through the Account, all Orders placed, and all obligations arising hereunder.
  • By using the Platform, You represent and warrant that: (a) all information You provide during registration and use is accurate, current, complete, and not misleading; (b) You shall promptly update such information if it changes; and (c) You are duly authorised to use the payment method provided for any Order.

5.1 Registration

  • To place Orders on the Platform, You must create an Account by providing a valid Indian mobile number and successfully completing the one-time password (OTP) verification process via SMS.
  • Only one (1) Account is permitted per mobile number. The creation of multiple accounts by the same individual — whether to circumvent account suspensions, exploit promotional offers, abuse Services, or for any other purpose — is strictly prohibited and shall constitute a material breach of these Terms.
  • You agree to provide accurate, current, and complete information during registration and throughout Your use of the Platform, and to update such information promptly if it changes.

5.2 Account Security

  • You are solely responsible for maintaining the confidentiality and security of Your Account, including safeguarding any OTPs received on Your registered mobile number. You shall not share Your OTP or Account access with any other person.
  • You agree to notify the Company immediately in writing at care@raagas.co.in of any unauthorised use of Your Account, any breach of security, or any suspected compromise of Your registered mobile number.
  • The Company shall not be liable for any loss, damage, or expense arising from Your failure to safeguard Your Account credentials or from any unauthorised use of Your Account. All activities and transactions conducted through Your Account — whether or not authorised by You — shall be deemed to have been conducted by You, and You shall be solely responsible therefor.

  • Upon termination, Your right to access and use the Platform shall immediately and automatically cease. Any pending Orders may be cancelled at the Company's sole discretion. Any pending refunds, credits, promotional balances, or other benefits associated with the Account may be forfeited. The Company shall not be liable for any loss, damage, or inconvenience resulting from such suspension or termination.
  • Termination of Your Account shall not relieve You of any obligations accrued prior to termination, including payment obligations, indemnification obligations, and liability for breach of these Terms.

6. Our Services

  • raagas is a quick service restaurant brand owned and operated by Carnatic Foods Private Limited. The Platform enables You to browse our Menu, customise food items, place Orders for food and beverage items, and arrange for delivery to Your address or takeaway (self-pickup) from our outlets.
  • The Company is not a marketplace, food aggregator, intermediary, or platform service provider. All food items listed on the Platform are prepared and sold directly by Carnatic Foods Private Limited through its own outlets, kitchens, and operations. The Company bears full responsibility for the food it prepares and sells, subject to the disclaimers and limitations set out in these Terms.
  • Services are subject to availability and may vary by outlet, geographic location, time of day, day of the week, season, and other operational factors. The Company reserves the right to modify, expand, suspend, or discontinue any Service, feature, or functionality of the Platform at any time, without prior notice and without liability to You.
  • The Company may, from time to time, expand its Services to include dine-in reservations, catering, meal plans, subscription services, loyalty programmes, gift cards, and other offerings. Such additional Services shall be governed by these Terms and any supplementary terms notified at the time of their launch.
  • The Company does not levy any service charge on Orders. The total amount payable is limited to the item prices, applicable taxes (GST), delivery charges, packaging charges, and any other fees explicitly displayed at the time of checkout.

7. Menu, Pricing and Availability

7.1 Menu

  • The Menu displayed on the Platform is subject to change at any time without prior notice, based on ingredient availability, seasonal factors, outlet-specific offerings, regulatory requirements, and operational considerations.
  • Food item images, graphics, and visual representations on the Platform are for illustrative and representational purposes only. They may include garnishes, props, styling elements, and presentation techniques that are not part of the actual product served. Actual products may vary in appearance, colour, texture, presentation, and portion size.
  • The Company endeavours to provide accurate descriptions of Menu items, including ingredients and allergen information, in accordance with the Food Safety and Standards (Labelling and Display) Regulations, 2020. However, the Company does not guarantee the absolute accuracy or completeness of such descriptions. Users with specific dietary requirements, food allergies, or intolerances are strongly advised to contact the outlet directly before placing an Order.

7.2 Pricing

  • All prices on the Platform are denominated in Indian Rupees (INR) and are inclusive of applicable Goods and Services Tax (GST) at the prevailing rate for restaurant services (currently 5%, comprising CGST 2.5% and SGST/UTGST 2.5%) unless otherwise explicitly stated.
  • Prices may vary between outlets, between ordering channels (delivery, takeaway, dine-in), and are subject to change at any time without prior notice. The Company reserves the right to implement dynamic pricing based on demand, time of day, or other factors.
  • In addition to item prices, the total Order Value may include: delivery charges, packaging charges, surge pricing (during periods of peak demand, adverse weather, or high order volume), platform fees (if applicable), and any other applicable charges or levies — all of which shall be clearly and separately displayed to the User on the checkout page before Order confirmation. No hidden charges shall be imposed.
  • In the event of a pricing error on the Platform — including but not limited to incorrect item prices, incorrect tax calculations, system glitches, or promotional pricing errors — the Company reserves the right to cancel the affected Order and issue a full refund of the amount paid. The Company shall not be obligated to fulfil Orders placed at incorrect prices.

7.3 Availability

Menu item availability is subject to real-time stock levels, outlet operating hours, order volume, and other operational constraints. An item displayed as available on the Platform may become unavailable by the time of Order processing. In such cases, the Company shall notify the User and may, at its sole discretion, offer a substitute item of equivalent or greater value, a partial refund for the unavailable item(s), or cancellation of the Order with a full refund.

8. Ordering Process

  • An Order placed by a User on the Platform constitutes an offer to purchase the selected items at the displayed price. It does not constitute acceptance by the Company. The Company reserves the absolute right to accept or reject any Order, in whole or in part, at its sole discretion and without assigning any reason.
  • An Order is deemed accepted only upon the Company transmitting an Order confirmation notification (via the Platform, SMS, email, or push notification) to the User. Until such confirmation is received, no binding contract exists between the User and the Company for that Order.
  • The Company may establish minimum order values for delivery Orders, which may vary by outlet, Delivery Area, time of day, and promotional periods. Orders below the applicable minimum value shall not be processed for delivery but may be available for takeaway.
  • Once an Order is confirmed and food preparation has commenced, modification of the Order — including adding, removing, substituting, or altering item quantities, customisations, or delivery details — shall not be permitted. Users who wish to add items must place a separate Order.
  • The Company reserves the right to contact the User via phone call, SMS, or in-app message to verify Order details, delivery address, payment, or identity — particularly for high-value Orders, first-time Users, Orders to new delivery addresses, or Orders flagged by the Company's fraud detection systems. Failure to respond to verification attempts may result in cancellation of the Order.

9. Payment Terms

9.1 Accepted Payment Methods

  • The Platform accepts payment through the following methods: credit cards and debit cards (Visa, Mastercard, RuPay, American Express, Diners Club), Unified Payments Interface (UPI), net banking, digital wallets (where supported), Buy Now Pay Later (BNPL) services (where available), and Cash on Delivery (COD) at select locations and subject to Order Value limits determined by the Company.
  • All payments are processed in Indian Rupees (INR) only. The Company does not accept payments in foreign currencies.

9.2 Payment Processing and Security

  • All online payments are processed through Cashfree Payments, a Payment Aggregator duly authorised by the Reserve Bank of India (RBI) under the Payment and Settlement Systems Act, 2007 and the RBI Master Direction on Payment Aggregators and Payment Gateways dated 17 March 2020. The Company does not directly process, store, or have access to Your complete card details.
  • Payment processing is secured using industry-standard 256-bit SSL/TLS encryption and processed through PCI-DSS Level 1 compliant payment infrastructure. Card data is tokenised in compliance with the Reserve Bank of India's Circular on Tokenisation dated 7 September 2021 (RBI/2021-22/62) and the RBI Master Direction on Digital Payment Security Controls dated 18 February 2021. The Company stores only tokenised card references and the last four digits of the card number for display and identification purposes.
  • The Company is not a banking institution, non-banking financial company, financial service provider, or payment system operator within the meaning of the Payment and Settlement Systems Act, 2007. The Company merely facilitates the collection of payments for food orders through authorised third-party payment service providers.

9.3 Payment Authorisation

  • By placing an Order and providing payment information, You authorise the Company (through its designated payment service provider) to charge the total Order Value to Your selected payment method. You represent and warrant that You are the lawful and authorised holder of the payment instrument used, and that all payment information provided is accurate and complete.
  • For COD Orders, the full Order Value is due and payable at the time of delivery. The User must tender exact or sufficient payment to the delivery personnel. Failure to pay at the time of delivery shall constitute a material breach of these Terms and shall entitle the Company to: (a) cancel the Order without refund; (b) restrict or permanently revoke the User's access to COD as a payment method; and (c) recover the Order Value and associated costs from the User.

9.4 Payment Failures and Holds

  • In the event of a payment failure, the Order shall not be processed. Any amount debited from Your account for a failed transaction shall be automatically reversed by the payment gateway or Your issuing bank within five (5) to ten (10) business days, subject to the processing timelines of Your bank and payment service provider.
  • Temporary authorisation holds placed on Your payment instrument at the time of Order placement shall be released if the Order is not confirmed or is subsequently cancelled by the Company. The timeline for release of such holds is determined by Your bank or payment service provider and is outside the Company's control.
  • For any queries regarding duplicate charges, excess debits, pending reversals, or other payment-related issues, Users may write to care@raagas.co.in with the Order ID, transaction reference number, and payment method details.

10. Cancellation and Refunds

  • Once an Order is placed and confirmed on the Platform, it cannot be cancelled, modified, or altered by the User. This policy is necessitated by the perishable nature of food products — food preparation commences immediately upon Order confirmation, and prepared food items cannot be resold, repurposed, repackaged, or returned to inventory. This is in accordance with the Consumer Protection (E-Commerce) Rules, 2020, which recognise the exemption of perishable goods from standard return and cancellation policies.
  • The Company reserves the right to cancel any Order at its sole discretion for operational, quality, safety, or regulatory reasons, including but not limited to the circumstances described in the Refund and Cancellation Policy. In all Company-initiated cancellations, a full refund shall be issued.
  • The complete terms governing refund eligibility, complaint timelines, evidence requirements, refund processing timelines, chargeback policy, and anti-fraud measures are set out in the Company's Refund and Cancellation Policy, available at raagas.co.in/legal/refund-policy, which is incorporated into these Terms by reference. Users are strongly advised to read the Refund and Cancellation Policy carefully before placing an Order.

11. Delivery Terms

  • The delivery of Orders is governed by the Company's Shipping and Delivery Policy, available at raagas.co.in/legal/delivery-policy, which is incorporated into these Terms by reference.
  • Estimated delivery times displayed on the Platform are approximate estimates only and do not constitute a guaranteed delivery time, a representation, or a warranty. Actual delivery times may vary due to factors beyond the Company's reasonable control.
  • The Company fulfils delivery through a combination of its own dedicated delivery fleet and third-party logistics partners ("Delivery Partners") engaged as independent contractors. While the Company takes responsibility for food safety and quality during transit, Delivery Partners are not employees, agents, or representatives of the Company, and the Company shall not be liable for the personal conduct, traffic violations, or acts of Delivery Partners that are beyond the scope of food delivery.
  • The Company shall not be liable for any loss, inconvenience, or damage resulting from delivery delays caused by factors beyond its reasonable control, including but not limited to traffic conditions, adverse weather, road closures, public disturbances, and Force Majeure Events.

12. Food Safety, Quality and Allergens

12.1 Food Safety and Licensing

  • The Company holds a valid FSSAI Central License issued by the Food Safety and Standards Authority of India. All raagas outlets operate in compliance with the Food Safety and Standards Act, 2006 ("FSSA"), the Food Safety and Standards (Licensing and Registration of Food Businesses) Regulations, 2011, the Food Safety and Standards (Food Safety Auditing) Regulations, 2018, and all other applicable food safety regulations.
  • The Company maintains rigorous food safety, quality assurance, and hygiene standards across all its outlets, covering raw material procurement, storage, preparation, cooking, packaging, dispatch, and delivery. All food handlers are trained in food safety and hygiene in accordance with FSSAI guidelines.

  • Allergen, nutritional, and dietary information provided on the Platform — including calorie counts, macronutrient values, and dietary classifications (vegetarian, non-vegetarian, vegan, Jain) — is approximate, based on standard recipes, and provided for general informational purposes only. Actual values may vary based on preparation methods, ingredient sourcing, seasonal variations, and portion sizes. This information does not constitute medical, nutritional, or dietary advice and should not be relied upon as a substitute for consultation with a qualified healthcare professional.
  • The Company makes no therapeutic, medicinal, or health claims regarding any food item on the Platform, in compliance with the Drugs and Magic Remedies (Objectionable Advertisements) Act, 1954 and the Food Safety and Standards (Advertising and Claims) Regulations, 2018.
  • Users with known food allergies, intolerances, or specific dietary requirements are strongly urged to contact the outlet directly before placing an Order. The Company shall not be held liable for allergic reactions, adverse health effects, or any injury or loss where the User has failed to exercise due diligence and reasonable care regarding their known dietary restrictions.

12.3 Food Quality and Consumption

  • All food items delivered or made available for takeaway by raagas are freshly prepared and intended for immediate consumption. The Company recommends consuming delivered food within thirty (30) minutes of delivery for optimal taste, texture, and food safety.
  • The Company shall not be liable for any deterioration in food quality, taste, safety, or condition arising from: (a) delayed consumption; (b) improper storage by the User after delivery; (c) reheating, refreezing, or other handling by the User; or (d) any alteration of the food product after it leaves the Company's control.
  • Users must inspect the Order upon receipt. Any concerns regarding food quality, safety, hygiene, tampering, or packaging integrity must be reported immediately and in no event later than the timelines specified in the Refund and Cancellation Policy.

13. Intellectual Property

  • All Content on the Platform — including but not limited to the "raagas" name, logo, brand identity, trademarks, service marks, trade dress, taglines, product names, domain names (raagas.co.in and all subdomains), graphics, photographs, illustrations, icons, audio clips, video clips, software, source code, object code, databases, page layout, visual design, and the selection, coordination, compilation, and arrangement thereof — is the exclusive property of Carnatic Foods Private Limited or its licensors and is protected under the Copyright Act, 1957, the Trade Marks Act, 1999, the Patents Act, 1970, the Designs Act, 2000, the Information Technology Act, 2000, and other applicable intellectual property laws of India and international treaties to which India is a party.

  • If You provide any feedback, suggestions, ideas, improvement proposals, or recommendations regarding the Platform, Services, Menu, or operations ("Feedback"), You hereby irrevocably and unconditionally assign to the Company all rights, title, and interest — including all Intellectual Property rights — in and to such Feedback, without restriction. 24.1 Severability

If any provision of these Terms (or any part thereof) is held to be invalid, illegal, void, or unenforceable by a court or tribunal of competent jurisdiction, such provision shall be severed from these Terms to the minimum extent necessary, and the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be deemed modified to the minimum extent necessary to make it valid, legal, and enforceable while preserving the original intent of the parties.

24.2 Waiver

No failure or delay by the Company in exercising any right, power, privilege, or remedy under these Terms shall operate as a waiver thereof. You shall not assign, transfer, delegate, sub-contract, or otherwise dispose of these Terms or any of Your rights, obligations, or liabilities hereunder, whether in whole or in part, without the prior written consent of the Company.
