The information, content, and materials provided on the raagas Platform (website, progressive web application, mobile applications, and related digital properties) operated by Carnatic Foods Private Limited ("Company", "we", "us", or "our") are for general informational purposes and to facilitate the ordering of food and beverages from raagas outlets. While the Company endeavours to keep all information accurate, current, and complete, the Company makes no representations or warranties of any kind — express, implied, statutory, or otherwise — about the completeness, accuracy, reliability, suitability, availability, timeliness, or fitness for any purpose of the Platform or any information, products, services, or materials contained on or available through it. Any reliance You place on such information is strictly at Your own risk. This Disclaimer is incorporated into, and forms part of, the Terms and Conditions (raagas.co.in/legal/terms).

2. No Warranty

THE PLATFORM AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES, REPRESENTATIONS, OR CONDITIONS OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, COMPLETENESS, AVAILABILITY, COMPATIBILITY, AND QUIET ENJOYMENT. THE COMPANY DOES NOT WARRANT THAT: (A) THE PLATFORM WILL BE AVAILABLE AT ALL TIMES, WILL OPERATE WITHOUT INTERRUPTION, DELAY, ERROR, OR OMISSION; (B) THE PLATFORM WILL BE FREE OF VIRUSES, MALWARE, RANSOMWARE, SPYWARE, OR OTHER HARMFUL COMPONENTS; (C) ANY DEFECTS, ERRORS, OR VULNERABILITIES IN THE PLATFORM WILL BE CORRECTED IN A TIMELY MANNER; (D) THE SERVERS, NETWORKS, AND INFRASTRUCTURE THAT MAKE THE PLATFORM AVAILABLE ARE FREE FROM VULNERABILITIES; OR (E) THE RESULTS OBTAINED FROM THE USE OF THE PLATFORM WILL BE ACCURATE, RELIABLE, COMPLETE, OR SUITABLE FOR ANY PARTICULAR PURPOSE.

4. Delivery Disclaimer

• Estimated delivery times displayed on the Platform are approximate only, calculated algorithmically, and are NOT guaranteed. Actual delivery times may vary due to factors beyond the Company's reasonable control, including traffic conditions, adverse weather, high order volume, road closures, delivery fleet capacity, and other unforeseen circumstances.
• The Company shall not be liable for any loss, inconvenience, expense, or damage resulting from delivery delays, regardless of the duration of the delay.
• The User is solely responsible for providing a complete, accurate, and accessible delivery address. The Company shall not be liable for failed deliveries, misdeliveries, or delivery delays resulting from incorrect, incomplete, ambiguous, or inaccessible address information provided by the User.
• The Company delivers through its own fleet and through third-party logistics partners ("Delivery Partners"). Delivery Partners are independent contractors and are not employees, agents, or representatives of Carnatic Foods Private Limited. While the Company takes responsibility for food safety during transit, the Company disclaims liability for the personal conduct, behaviour, traffic violations, or acts of Delivery Partner personnel beyond the scope of food delivery.

5. Pricing Disclaimer

• Prices displayed on the Platform are subject to change at any time without prior notice and may vary between outlets, ordering channels (delivery vs takeaway), and time periods. The Company may implement dynamic pricing based on demand, supply, time, or other operational factors.
• In the event of a pricing error on the Platform — including incorrect item prices, tax calculation errors, system glitches, or promotional pricing malfunctions — the Company reserves the right to cancel the affected Order and issue a full refund. The Company is not obligated to fulfil Orders placed at incorrect or erroneously displayed prices.
• Promotional offers, discount codes, cashback, and referral rewards are subject to specific terms and conditions and may be modified, suspended, or withdrawn at any time at the Company's sole discretion without prior notice and without liability.
• The Company does not levy any service charge on Orders. The Company hereby clarifies, in line with the guidelines issued by the Central Consumer Protection Authority (CCPA), that no compulsory service charge is imposed on Users. The total amount payable is limited to item prices, applicable taxes (GST), delivery charges, packaging charges, and any other fees explicitly disclosed at the time of checkout.

7. Payment Disclaimer

• All online payment processing on the Platform is handled by Cashfree Payments, a Payment Aggregator duly authorised by the Reserve Bank of India under the Payment and Settlement Systems Act, 2007. The Company is not a banking institution, non-banking financial company, payment system operator, or financial service provider.
• The Company disclaims all liability for: (a) payment gateway failures, downtime, or processing errors; (b) declined transactions due to insufficient funds, expired cards, bank-imposed limits, or issuer-side restrictions; (c) delays in payment processing, settlement, or refund crediting caused by the User's issuing bank, card network, or payment service provider; (d) charges imposed by the User's bank or card issuer (including currency conversion fees, international transaction fees, or convenience charges); (e) 3D Secure (3DS) authentication failures, which are the responsibility of the User's issuing bank and the card network, not the Company; and (f) any other issues arising from the payment infrastructure of banks, card issuers, UPI providers, or other payment intermediaries that are outside the Company's control.
• Users are solely responsible for ensuring: the accuracy of their payment information, sufficient available funds or credit limit, the validity and non-expiry of the payment instrument used, and that the payment method is not blocked, flagged, or restricted by the issuing bank.

8. Third-Party Links, Content, and Services

The Platform may contain links to, or integrations with, third-party websites, applications, content, or services that are not owned, operated, or controlled by the Company. These links and integrations are provided solely for the convenience of Users. The Company exercises no control over and assumes no responsibility for the content, privacy policies, data practices, terms of use, availability, accuracy, or security of any third-party services. The inclusion of any third-party link or integration on the Platform does not imply endorsement, approval, affiliation, association, sponsorship, or recommendation by the Company. Users access third-party services entirely at their own risk, and the Company disclaims all liability for any loss, damage, or harm arising from the User's interaction with third-party services.

9. User-Generated Content

The Platform may display user-generated content including reviews, ratings, photographs, comments, and feedback submitted by Users. Such content reflects the personal opinions, views, and experiences of individual Users and does not represent the views, endorsement, recommendations, or positions of the Company. The Company does not independently verify the accuracy, completeness, truthfulness, objectivity, or reliability of user-generated content. The Company disclaims all liability for any false, misleading, inaccurate, defamatory, offensive, discriminatory, or otherwise harmful or objectionable content posted by Users. The Company reserves the right (but assumes no obligation) to moderate, edit, or remove user-generated content at its sole discretion.

10. FSSAI and Regulatory Compliance

The Company holds a valid FSSAI Central License issued by the Food Safety and Standards Authority of India and operates in compliance with the Food Safety and Standards Act, 2006, the Food Safety and Standards (Licensing and Registration of Food Businesses) Regulations, 2011, and all other applicable food safety regulations and standards. While the Company maintains rigorous food safety, quality assurance, and hygiene standards across all its outlets and operations, the Company cannot and does not guarantee the elimination of all risks associated with food products — including but not limited to the risk of allergic reactions, food-borne illness, individual adverse reactions to specific ingredients, cross-contamination, and variations in taste, texture, or quality. Users consume food products at their own risk and are strongly advised to exercise due diligence and caution regarding their individual dietary restrictions, food allergies, health conditions, and dietary needs.

11. Geographic Limitations

The Platform and Services are designed, intended, and made available for use exclusively within the Republic of India. The Company makes no representation, warranty, or guarantee that the Platform, its Content, or Services are appropriate, available, compliant, or lawful for use in jurisdictions outside India. Users who access the Platform from locations outside India do so at their own risk, on their own initiative, and are solely responsible for compliance with local laws, regulations, and restrictions of their jurisdiction. The Company disclaims all liability for any consequences arising from access to or use of the Platform from outside India.

12. Caution Notice

• IMPORTANT PUBLIC NOTICE: The Company has been made aware of fraudulent entities, individuals, and organised groups impersonating raagas and Carnatic Foods Private Limited through fake websites, social media accounts, WhatsApp groups, email communications, and phone calls, for the purposes of unauthorised solicitation, phishing, identity theft, financial fraud, and other criminal activities.
• The Company hereby cautions the general public that: (a) the Company does NOT solicit investments, franchise fees, dealership deposits, distributorship payments, or any other financial contributions from the public — Carnatic Foods Private Limited is a company-owned and company-operated business and does NOT offer franchise, dealership, or distributorship opportunities; (b) the Company does NOT conduct recruitment, hiring, interviews, or onboarding through WhatsApp, Telegram, social media direct messages, or any unofficial communication channels — all legitimate recruitment communications originate exclusively from @raagas.co.in email addresses; (c) the Company does NOT request payment of any kind for job offers, interview scheduling, employment confirmation, training, or background verification; (d) the Company does NOT conduct surveys, contests, or prize draws that require the sharing of bank details, OTPs, Aadhaar numbers, PAN numbers, or other sensitive personal or financial information.
• Official communication channels of raagas and Carnatic Foods Private Limited: Website: raagas.co.in | Email: Only @raagas.co.in domain | Customer support: care@raagas.co.in. Any communication purporting to be from raagas or Carnatic Foods Private Limited that does not originate from the above official channels should be treated as potentially fraudulent and should not be responded to.
• The Company shall not be liable or responsible for any loss, damage, or harm suffered by any person as a result of engaging with, relying upon, or acting on such fraudulent communications, impersonation, or scams.
• Suspicious or fraudulent communications should be reported to: (a) care@raagas.co.in; and (b) the National Cyber Crime Reporting Portal at cybercrime.gov.in or the Cyber Crime Helpline at 1930. The Company reserves the right to initiate civil and criminal proceedings against perpetrators under the Bharatiya Nyaya Sanhita, 2023 (including Section 319 — cheating by personation, and Section 336 — forgery) and the Information Technology Act, 2000 (including Section 66D — punishment for cheating by personation using computer resource).

13. Force Majeure

The Company shall not be liable for any failure or delay in performance of any of its obligations arising from or attributable to circumstances beyond its reasonable control, including but not limited to: acts of God, natural disasters, adverse weather, epidemics, pandemics, public health emergencies, fire, explosion, war, armed conflict, terrorism, riots, civil unrest, strikes, lockouts, labour disputes, government actions or orders, sanctions, embargoes, curfews, shutdowns, changes in law or regulation, failure of utility services (electricity, water, telecommunications, internet), cyber attacks, system failures, data centre outages, supply chain disruptions, raw material shortages, transportation disruptions, and any other events of similar nature beyond the Company's reasonable control. During such events, the Company's obligations shall be suspended for the duration of the force majeure event.

14. Limitation of Liability and Indemnification

• To the maximum extent permitted by Applicable Law, Carnatic Foods Private Limited, its directors, officers, employees, agents, affiliates, successors, and assigns shall not be liable for any indirect, incidental, special, consequential, exemplary, punitive, or aggravated damages — including but not limited to loss of profits, revenue, data, goodwill, business opportunity, or anticipated savings — arising from or in connection with the use of or inability to use the Platform or Services, howsoever caused, even if the Company has been advised of the possibility of such damages.
• The Company's total aggregate liability for any claim arising out of or in connection with this Disclaimer, the Platform, or the Services shall not exceed the amount actually paid by You for the specific Order directly giving rise to the claim.
• Nothing in this Disclaimer excludes the Company's liability for: death or personal injury caused by the Company's proven negligence; fraud or fraudulent misrepresentation; wilful misconduct or gross negligence; or any liability that cannot be excluded or limited under Applicable Law, including under the Consumer Protection Act, 2019 and the Food Safety and Standards Act, 2006.
• By using the Platform, You agree to indemnify, defend, and hold harmless the Company, its directors, officers, employees, agents, affiliates, and successors from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from: Your use of the Platform or Services; Your violation of this Disclaimer, the Terms and Conditions, or any Applicable Law; Your violation of any third-party rights; or any fraudulent, abusive, or illegal activity conducted through Your Account.

15. Governing Law, Modifications, and Severability

• This Disclaimer is governed by and shall be construed in accordance with the laws of India. Any disputes arising out of or in connection with this Disclaimer shall be subject to the exclusive jurisdiction of the competent courts at Villupuram, Tamil Nadu, India, subject to the User's right to approach Consumer Disputes Redressal Commissions under the Consumer Protection Act, 2019.
• The Company reserves the right to modify, amend, or update this Disclaimer at any time at its sole discretion. Changes shall be effective immediately upon publication on the Platform with an updated "Last Updated" date. Your continued use of the Platform after the publication of changes constitutes Your acceptance of the updated Disclaimer.
• If any provision of this Disclaimer (or any part thereof) is held to be invalid, illegal, void, or unenforceable by a court or tribunal of competent jurisdiction, such provision shall be severed to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
